Welcome to Athlete5. These Terms & Conditions govern your use of the Athlete5 website, services, assessments, reports, advisory offerings, content, communications, and related materials.

By using this website, submitting information, completing a form, purchasing services, scheduling a consultation, participating in an Athlete5 assessment, or engaging with Athlete5 in any way, you agree to these Terms & Conditions.

1. About Athlete5

Athlete5, LLC helps athletes and former athletes gain clarity, direction, and structure for life beyond sports.

Services may include assessments, reports, personal development guidance, career exploration, leadership insight, advisory support, coaching-style conversations, accountability, and related resources.

Athlete5 is designed to support personal growth, career clarity, purpose, performance, and transition planning.

2. Adult Users Only

Athlete5 services are intended for individuals age 18 and older.

By using Athlete5, submitting a form, purchasing a service, or participating in an assessment, you confirm that you are at least 18 years old.

3. Former Collegiate Athletes

Athlete5 may work with former collegiate athletes after their college athletic careers have ended.

Athlete5 does not provide NCAA eligibility advice, NIL compliance guidance, legal representation, agent services, school compliance services, or institutional athletic department advisory services.

4. No Medical, Mental Health, Legal, Financial, or Clinical Advice

Athlete5 does not provide medical, mental health, therapy, legal, financial, or clinical services.

Any content, assessment, advisory session, recommendation, report, communication, or resource provided by Athlete5 is for informational, educational, personal development, leadership, career clarity, and transition support purposes only.

Athlete5 may discuss high-level topics related to purpose, identity, mindset, wellness, faith, relationships, life direction, and personal growth. These discussions are not a substitute for licensed medical care, therapy, counseling, legal advice, financial planning, or crisis support.

You are responsible for consulting qualified professionals for medical, psychological, legal, financial, or other regulated advice.

If you are experiencing a mental health crisis, medical emergency, or thoughts of self-harm, contact emergency services or a qualified crisis support provider immediately.

5. Services and Assessments

Athlete5 may offer services including but not limited to:

  • Athlete5 Blueprint assessments

  • Intake forms

  • Personalized reports

  • Advisory sessions

  • Coaching-style support

  • Career and transition guidance

  • Personal development resources

  • One-time service packages

  • Recurring monthly Elite Advisory services

  • Digital or written materials

Assessment results, recommendations, archetypes, reports, or advisory insights are intended to help guide reflection, clarity, and action. They are not guarantees of career placement, income, business results, athletic performance outcomes, mental health improvement, personal transformation, or specific life outcomes.

Your results depend on many factors, including your effort, follow-through, circumstances, decisions, openness, and willingness to take action.

6. User Responsibilities

You agree to:

  • Provide accurate and truthful information

  • Use Athlete5 services for lawful purposes

  • Respect the confidentiality and intellectual property of Athlete5

  • Not misuse, copy, resell, distribute, or exploit Athlete5 materials without permission

  • Take personal responsibility for your decisions and actions

  • Seek qualified professional help when needed for medical, mental health, legal, financial, or crisis-related matters

7. Payments

Athlete5 may offer one-time purchases, recurring monthly advisory services, subscription-based offerings, or other paid services.

By purchasing a service, you agree to pay the fees stated at the time of purchase, checkout, invoice, or written agreement.

Payments may be processed through third-party payment providers. Athlete5 has not finalized every payment processing platform and may use providers such as Stripe, PayPal, website checkout tools, invoicing tools, or other secure payment processors.

Athlete5 is not responsible for payment delays, errors, failed transactions, platform outages, or security issues caused by third-party payment providers.

8. Recurring Payments and Elite Advisory Services

If you enroll in a recurring monthly service, including Elite Advisory, you authorize Athlete5 or its payment processor to charge your selected payment method according to the agreed billing schedule.

Recurring services continue until canceled according to the cancellation terms provided at the time of purchase, agreement, or invoice.

You are responsible for keeping your payment information current. Failed or delayed payments may result in paused services, delayed deliverables, or termination of access.

9. Refunds and Cancellations

Refunds and cancellations are handled on a case-by-case basis.

Athlete5 may consider refunds, credits, rescheduling, or cancellations depending on the nature of the service, work already completed, time already reserved, reports already delivered, and the specific circumstances involved.

Unless otherwise agreed in writing, completed assessments, delivered reports, completed consultations, rendered advisory sessions, and completed service work may not be eligible for a refund.

For recurring advisory services, cancellation terms may be provided separately in writing, through checkout, invoice, or service agreement.

10. Scheduling, Rescheduling, and Missed Appointments

If you schedule a consultation, assessment session, advisory session, or meeting, you are responsible for attending at the scheduled time.

Athlete5 may set policies for late arrivals, missed appointments, cancellations, and rescheduling. These policies may vary depending on the service purchased.

Missed appointments may not be refundable or may count as completed sessions unless otherwise agreed by Athlete5.

11. SMS and Text Message Terms

By providing your phone number and opting in to receive text messages from Athlete5, you agree to receive SMS or text communications related to inquiries, consultations, services, reminders, resources, offers, or updates.

Message frequency may vary. Message and data rates may apply.

You may opt out of marketing or promotional text messages at any time by replying STOP, UNSUBSCRIBE, CANCEL, or by contacting eric@athlete5.com.

Consent to receive marketing text messages is not required as a condition of purchasing any Athlete5 service.

12. Email Communications

By submitting your email address, you agree to receive communications from Athlete5, including service messages, scheduling updates, resources, newsletters, and marketing communications.

You may unsubscribe from marketing emails at any time. Service-related, transactional, scheduling, or payment communications may still be sent where necessary.

Your use of the website may result in Athlete5 advertising being shown to you on third-party platforms, depending on your browser settings, platform settings, and applicable law.

Athlete5 will only publicly use your name, likeness, testimonial, identifiable client story, or specific results after receiving your agreement or consent.

All Athlete5 content, frameworks, assessments, reports, archetypes, messaging, graphics, videos, resources, website copy, tools, materials, and related intellectual property are owned by Athlete5, LLC or its licensors.

You may not copy, reproduce, distribute, modify, publish, sell, license, share, or create derivative works from Athlete5 materials without prior written permission.

Your purchase or participation in an Athlete5 service gives you a limited, personal, non-transferable right to use the materials provided to you for your own personal development. It does not give you ownership of Athlete5 intellectual property.

16. Confidentiality

Athlete5 may receive personal information through forms, assessments, consultations, advisory sessions, or communications.

Athlete5 will take reasonable steps to treat your personal information with care. However, Athlete5 does not guarantee legal privilege, therapist-client confidentiality, medical confidentiality, or any other regulated professional confidentiality unless expressly required by law.

You agree not to disclose, distribute, or publish confidential Athlete5 materials, proprietary frameworks, assessment content, reports, or private advisory materials without written permission.

You agree not to use the Athlete5 website in a way that could damage, disable, disrupt, overload, or interfere with the website, services, systems, or other users.

You may not attempt to gain unauthorized access to any portion of the website, servers, systems, data, accounts, forms, or payment tools.

Athlete5 does not guarantee specific outcomes, including but not limited to:

  • Job offers

  • Income

  • Athletic performance

  • Mental health improvement

  • Personal transformation

  • Relationship outcomes

  • Spiritual growth

  • Life satisfaction

  • Leadership success

  • Any other specific result

Athlete5 provides guidance, insight, structure, accountability, and support. You remain responsible for your decisions, effort, follow-through, and outcomes.

20. Limitation of Liability

To the fullest extent permitted by law, Athlete5, LLC and its owners, team members, contractors, partners, affiliates, and representatives are not liable for any indirect, incidental, consequential, special, punitive, or other damages arising from your use of the website, services, assessments, reports, advisory guidance, communications, or materials.

You agree that your use of Athlete5 is at your own discretion and risk.

21. Indemnification

You agree to defend, indemnify, and hold harmless Athlete5, LLC, its owners, team members, contractors, partners, affiliates, and representatives from any claims, damages, liabilities, losses, expenses, or demands arising from your use of the website or services, your violation of these Terms, your submitted information, or your decisions based on Athlete5 content, guidance, or communications.
